Heim, Payne & Chorush LLP Helps Wapp Tech Companies Resolve Patent Infringement Lawsuit Against Wells Fargo

Heim, Payne & Chorush LLP helped Wapp Tech Corp. and Wapp Tech Limited Partnership resolve the companies’ patent infringement litigation against California’s Wells Fargo Bank, N.A. (“Wells Fargo”).

Firm partner Les Payne led the Heim, Payne & Chorush team on behalf of the Wapp entities with fellow firm partners Allan Bullwinkel and Alden Harris and associate Chris Limbacher.

Heim, Payne & Chorush filed the lawsuit on behalf of Wapp in August 2021 before the U.S. District Court for the Eastern District of Texas in Sherman. The case came on the heels of Wapp’s jury verdict of $172.5 million in March 2021 against Hewlett Packard spinoff Micro Focus International, which was subsequently settled for $67.5 million.

Wapp asserted infringement against Wells Fargo based on five patents that cover software tools used to develop and test applications for mobile devices. The case focused on Wells Fargo’s use of various software tools to create and test its mobile banking applications. Before the notice of settlement was filed in late September, the Heim, Payne & Chorush attorneys secured a Markman ruling on numerous issues in favor of Wapp.

The case is Wapp Tech Corp. and Wapp Tech Limited Partnership v. Wells Fargo Bank, N.A., No. 4:21-cv-671-ALM.
